Child Custody

In Colorado, the term “child custody” is synonymous with “parental responsibilities.” A parent with decision-making responsibilities decides such important matters as education, medical and mental health issues, religion and extra-curricular activities. For the day-to-day issues, each parent decides those while the child is in his or her care. 

Whether to pursue sole decision-making responsibilities or joint decision-making responsibilities depends upon your individual circumstances. The court’s overriding consideration is what is in the child’s best interest based upon a number of factors, including who has historically been the primary caretaker and who is able to provide responsible parental care.

Parenting Time

Parenting time used to be called visitation. However, the term parenting time more accurately reflects the parent’s role while the child is in her or his care. In most cases, the Colorado court encourages both parents to have substantial involvement in their children’s lives and to cooperate with each other to that end.

We help you arrange a parenting time plan that gives you the most time possible with your children and incorporates your unique circumstances. We consider issues such as your work schedule, your intended location after divorce, and the celebration of important religious, cultural, and family holidays.

Child Support

Both parents should share the financial responsibility of raising your children. Child support depends on each parent’s income, expenses for the children paid by a parent and the amount of overnights spent with each parent.  Colorado’s child support guidelines calculate how much a parent is required to pay each month. The court has discretion to adjust basic child support for high-income parents and to award additional child support to cover extraordinary expenses. Our attorneys pursue an equitable allocation of child support that is fair to you and your children.

Modification of Child Support

Life changes after divorce, and so may your financial situation. A lost job or serious injury may impede your ability to pay the amount of child support originally ordered. Your changed circumstances may qualify you for a modification of your child support. Keep in mind that no matter the change in circumstances you continue to owe the amount ordered until a judge has issued a new order.  Our attorneys are skilled at reviewing the financial situation and helping you in getting new child support orders when appropriate.
