Divorce & Legal Separation

Our attorneys are your loyal advocates throughout your divorce. We pursue your best outcomes in such crucial issues as division of assets, parenting matters, child support and maintenance. We negotiate for the best possible divorce settlement, and often resolve your case through mediation which is a less stressful, less expensive and more expeditious means of divorce. However, we are trial lawyers who are ready to take your case before a judge to advocate for your rights if in your best interest to do so.

If you are considering a legal separation, know you have rights in financial and parenting time matters. Our lawyers strategize to help you reach an equitable separation agreement that protects your rights.  If reaching an agreement cannot be accomplished, we will take your matter to trial to ensure the best possible outcome for you.

Spousal Support, Maintenance & Alimony

Maintenance (formerly known as alimony or spousal support) is not guaranteed under Colorado laws. The courts consider several factors when deciding whether to award maintenance, including length of the marriage and need of one spouse for financial assistance after the divorce. Our lawyers advocate for your fair treatment in maintenance matters. We can seek an order awarding you maintenance, help you to reduce your maintenance payments or increase the amount you receive, depending upon your specific circumstances.

Marital Property & Asset Division

As with a business partnership, you accumulated numerous assets and acquired debts as a married couple. We help you disentangle this financial partnership during dissolution. We handle distribution of high-value and complicated assets, including real estate, retirement funds, family businesses, investments, securities and collectables. We also assist you in allocating extensive debts, such as mortgages, student loans and credit card bills.

Colorado laws support the equitable distribution, rather than the equal distribution, of marital assets. Separate property generally is not subject to division. Gifts, inheritances and property described in a prenuptial or marital agreement are also generally not included as a marital asset. Our firm can assist in tracing the typically complex path of ownership and asset comingling that affects whether property is considered marital or separate.

Parenting Time and Decision Making, Child Custody & Child Support

Our lawyers are thoughtful about how divorce can affect children and we make your children our priority as we guide you through the terms of parenting time, decision making, child custody and child support. We help you negotiate a settlement that is in your children’s best interests and that is tailored to your individual circumstances. We are also ready to fight for your parental rights in court if the other parent does not put your children’s interests above her or his own.

If your finances have changed substantially, our firm helps you obtain a modified order of child support. If you or the other parent decides to move away out-of-state or out-of-area, we represent you in relocation proceedings.
